This Privacy Policy is applicable to Pro Bono Advisory Group (collectively referred to in this Privacy Policy as “PRO BONO”, “we”, “our” or “us”) and sets out our policy on the gathering and use of information on this site and our other sites (collectively "Sites"). PRO BONO is committed to providing safe web sites for visitors of all ages and has implemented this Privacy Policy to demonstrate our firm commitment to your privacy. PRO BONO complies with Canadian Federal and Provincial privacy laws and regulations including the Personal Information and Electronic Documents Act.

There may be links from our Sites to other web sites; note that this Privacy Policy applies only to our Sites and not to web sites of other companies or organizations to which our Sites may be linked. You must check on any linked sites for the privacy policy that applies to that site and/or make any necessary inquiries in respect of that privacy policy with the operator of the linked site. These links to third party websites are provided as a convenience and are for informational purposes only. PRO BONO does not endorse, and is not responsible for, these linked websites.

Although you are not required to register to access our Sites, you may be asked to provide us with personal information when you visit certain sections of our Sites. Your use of our Sites signifies your acknowledgement and consent to our Privacy Policy. If you do not agree to this Privacy Policy, please do not continue to use our Sites. Your continued use of the Sites signifies your acceptance of these terms and any changes in effect at the time of use.

 

Pro Bono respects the privacy rights of our client organizations, associates, volunteers and advisors, and is committed to protecting all personal information in our possession or control. We have adopted this Privacy Policy to guide how we collect, use and disclose the personal information we require in the course of fulfilling our responsibilities and supporting client organizations. This Privacy Policy applies to all subsidiaries and associated companies and partnerships of PRO BONO Advisory Group.

 

PRO BONO takes the privacy of our client organizations, associates, volunteers and advisors very seriously. We have developed this Privacy Policy to clearly define our ongoing commitment to protecting the privacy rights of our client organizations, associates, volunteers and advisors. PRO BONO’s policy is to at all times adhere to the requirements of applicable law and professional responsibilities, and to be responsive to our client organizations, associates, volunteers and advisors who expect us to respect their privacy and to protect their personal information.

 

For purposes of this Privacy Policy, the term “personal information” means information about an identifiable individual, as more specifically defined by applicable privacy legislation.

 

PRO BONO is accountable for all personal information in our possession or control. This includes any personal information that we receive directly from individual client organizations, organizations, associates, volunteers, advisors, and PRO BONO personnel, as well as any personal information that we may receive indirectly, for example, through corporate and government client organizations. We have established policies and procedures aimed at protecting the personal information of our client organizations and PRO BONO personnel.

 

Client Organizations Personal Information

In most instances, PRO BONO will collect, use or disclose personal information about client organizations only for the purpose of providing professional services, to comply with applicable laws, regulations and professional standards, or for the purpose of obtaining technological, administrative, analytical and clerical services or support.

 

Client organizations personal information may also be collected, used or disclosed internally and to other member firms of the PRO BONO network for the purpose of compliance with PRO BONO policies and processes, in the performance of quality reviews, or in order to allow us to offer services or products that may be of interest to client organizations.

 

PRO BONO may also collect, use or disclose personal information about client organizations, prospective client organizations and alumni for the purpose of sending news and information updates or invitations to events hosted or sponsored by PRO BONO.

 

PRO BONO may also aggregate personal information with information from other sources for the purpose of improving quality and service, and for use in presentations to client organizations and non-client organizations, in a form where such information is sufficiently de-identified so as not to be attributable to any individual or organization.

The terms and conditions of every PRO BONO professional services engagement are documented in a service agreement. These terms and conditions include a discussion about how PRO BONO may collect, use and disclose client organizations personal information. By signing the service agreement, the client organizations is providing its consent to the collection, use and disclosure of personal information described in the terms and conditions. If a client organization provides us with personal information relating to a third party, by signing the service agreement the client organizations represents and warrants that they have obtained consent from the third party to allow us to collect, use and disclose their personal information as described in the engagement letter.

 

PRO BONO client organizations always have the option not to provide their consent to the collection, use and disclosure of their personal information, or to withdraw their consent at a later stage, subject to contractual and legal restrictions and reasonable notice. Where a client organization chooses not to provide us with permission to collect, use or disclose their personal information, we may not be able to provide, or continue to provide, the client organizations with our services.

Partner, Associate and Volunteer Information

PRO BONO collects, uses and discloses personal information about PRO BONO Partners, Associates and Volunteers (collectively referred to in this Privacy Policy as “Personnel”)

in order to provide compensation, to comply with laws, regulations and professional standards, to administer performance management tools, to administer, manage, enforce and monitor compliance with PRO BONO programs, policies, and generally to establish, manage or terminate the personnel relationship.

 

PRO BONO may also collect, use or disclose PRO BONO personnel personal information to develop business metrics and analytics, and to evaluate the effectiveness of our policies, programs and processes.

 

We may also collect, use or disclose PRO BONO personnel personal information in the course of investigating, negotiating or completing a business transaction involving all or any part of our business.

 

We also collect, use and disclose personal information from individuals seeking to join PRO BONO for the purpose of evaluating their application, to communicate with them regarding opportunities that may be of interest, and for the purpose of evaluating or monitoring PRO BONO policies, programs and practices

 

Use and Disclosure of Personal Information

If PRO BONO intends to use or disclose personal information for any purpose not previously identified to an individual, we will obtain their prior consent unless we are permitted or required by law to use or disclose their personal information without consent.

For example, but without limitation, PRO BONO may use and disclose personal information without consent:

  • for the purpose of acting in respect of an emergency that threatens the life, health or security of an individual, including steps taken under our pandemic policies;

  • to prevent, detect or suppress fraud or financial abuse;

  • in connection with an investigation;

  • to comply with a subpoena, a warrant or an order made by a court or other body with appropriate jurisdiction or to comply with rules of conduct required by regulatory bodies;

  • to a government institution that has requested the information, identified its lawful authority, and has indicated that disclosure is for the purpose of enforcing, administering, carrying out an investigation, or gathering intelligence relating to any federal, provincial or foreign law, or to national security or the conduct of international affairs; and

  • to an investigative body or government institution on our initiative when we believe the information concerns a breach of an agreement, or a contravention of a federal, provincial, or foreign law, or we suspect the information relates to national security or the conduct of international affairs.

 

Retention of Personal Information

In compliance with professional standards, we keep a record of the work performed by PRO BONO. This record, or “working papers”, may include personal information and will be retained until such working papers are no longer reasonably required for legal, administrative, audit, regulatory or professional purposes. Working papers are safeguarded against inappropriate access, as discussed below.

 

PRO BONO retains personal information about current and past PRO BONO personnel in accordance with employment laws and standards. We will destroy human resources and other files containing PRO BONO personnel personal information when such information is no longer reasonably required for legal, administrative, audit or regulatory purposes.

 

Protection of Information

PRO BONO will limit the collection of personal information to that which is reasonably required to provide our services.

 

We have put in place physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online. PRO BONO applies security safeguards appropriate to the sensitivity of the information, such as retaining information in secure files and making personal information accessible only to authorized employees on a need-to-know basis.

Personal information you share with us is stored on our database servers at Company data centers (in whatever country they may be located), or hosted by third parties who have entered into agreements with us that require them to observe our Privacy Policy.

 

We are responsible for all personal information transferred to third party service providers. We require third party service providers to respect the confidentiality of personal information and all legal requirements under applicable Canadian federal and provincial privacy legislation, and to agree to contractual requirements that are consistent with this Privacy Policy. These third-party service providers are prohibited from using personal information except for the specific purpose(s) for which we supply it to them.

 

In some circumstances, personal information may be collected, used, disclosed or stored outside of Canada, including but not limited to in the U.S., EU and Asia, by PRO BONO or a third party to provide professional services and administrative, analytical and clerical support, and to comply with applicable law, regulation and professional standards, and such personal information may be subject to disclosure in accordance with the laws applicable in the jurisdiction in which the information is collected, used, disclosed or stored. These laws may not provide the same level of protection as Canadian privacy laws.

 

Client organizations and PRO BONO personnel have the right to review and obtain a copy of their personal information on record in our individual offices.  The right to access personal information is subject to certain legal restrictions and we will take reasonable steps to verify an individual’s identity before providing access.

Cookies 
When you view our website, we might store some information on your computer. This information will be in the form of a “cookie” or similar file. Cookies are small pieces of information stored on your hard drive, not on our site. Cookies, which are tied to personal information, do not spy on you or otherwise invade your privacy, and they cannot invade your hard drive and steal information. Rather, they help you navigate a website as easily as possible. Cookies can help us provide information that is targeted to your interests and they allow us to better understand how users use our site, which in turn helps us focus our resources on features that are most popular with our users.
